Privacy Policy for the Cleverest-App

This privacy policy informs you about the purposes for which personal data is collected, processed and used when you use the Cleverest application (hereinafter: “Cleverest App“).

1. Contact Person and Person Responsible for Data Processing

The Cleverest App is offered by Martian & Machine GmbH, Falckensteinstraße 49, 10997 Berlin (hereinafter: "Martian & Machine" or "we"). Martian & Machine is also responsible for the collection, processing and use of personal data of Cleverest App users (hereinafter "you") within the meaning of the EU Data Protection Regulation (DSGVO).

2. Our Privacy Policy

The protection and secure processing of your data is of central importance to us. Therefore we attach great importance to the observance of the specifications of the European and German data protection law.

The information you provide remains your data. We will only process your data for the purposes described in this data protection declaration

3. Data Processing when using the Cleverest-App

3.1 Registration

You can download the Cleverest app from an app store - but you use the app without any registration, so we don't store any personal information about you. All data will only be stored on your device.

At the end of the "Introduction Tutorial" we ask you to read the General Terms of Use and this Privacy Policy.

3.2 Download from an App-Store

In order to download and install the Cleverest App from an App Store (Google Play, Apple AppStore), you must first set up a user account with the provider of the respective App Store and conclude a corresponding user contract. We have no influence on the content of this user contract, in particular we are not a party to such a user contract. When downloading and installing the App, the necessary information is transferred to the respective provider of the App Store (Google or Apple), in particular the user name, your e-mail address and the customer number of your App Store account, the time of download and individual device IDs. We have no influence on this data collection and are not responsible for it. We only process the data provided insofar as this is necessary for downloading and installing the app on your mobile device (e.g. iPhone, iPad or Android Device). In addition, this data is not further stored by us. The legal basis for this data processing is Art. 6 para. 1 lit. b DSGVO.

3.3 Using the App

When you use the Cleverest app, we collect the following technical data to enable the functions of the app, which is automatically collected by your mobile device and transmitted to us when you use it (this data is hereinafter referred to collectively as "usage data"):

• The device designation (e.g. “Apple iPhone 8“ or “Samsung Galaxy S9“)
• Operatingsystem and version
• App-version and applications-ID to identify your App Installation
• System language set
• General data such as language and regional settings
• IP-Adress of the terminal device
• Date and time of use

To improve the quality of the app, the app also sends us error messages after a crash (i.e. after the app was unexpectedly terminated due to a program error or it no longer responded to your input). The error messages do not contain any personal data, but only the aforementioned technical device information as well as information about which part of the software code of the app caused the error.

The usage data is logged in internal log files for a period of three months after the end of the respective access and then anonymized.

We use the usage data and any error messages to enable the function of the app and to identify and eliminate any security risks or malfunctions and to ensure the stability of our systems.

The legal basis for this data processing is Art. 6 para. 1 lit. b DSGVO, as far as the provision of app functions is concerned, and Art. 6 para. 1 lit. f DSGVO, according to which data processing is permitted to safeguard legitimate interests, as far as the collection and further processing of data in internal log files is concerned. Our legitimate interests are the safeguarding of app functions, error detection and correction and the early detection and defence against cyber attacks

3.4 Support

If you have any questions regarding the Cleverest app, you can always contact our customer support. You can access support by clicking the "Contact-us" button in your account settings in the app. You can use the support to ask questions about the use of the app, the web registration and for general understanding. Of course you can also inform us about bugs or errors of the app. The legal basis for processing your support requests is Art. 6 Para. 1 lit. b DSGVO. We store the support requests addressed to us as well as our answers for proof purposes for a period of 18 months after conclusion of the support case. The data is then automatically anonymized.

4. Utilization Data Analysis

In the following, we explain data processing for the purpose of analyzing usage data in the Cleverest app.

As mentioned earlier, Cleverest does not store any personal data - all data is only stored on your device. However, in order to constantly improve the app, Analytics has been integrated into Cleverest. However, these analytics are not personal. The services included in this section allow the owner to monitor and analyze web traffic and anonymous user behavior.

Google Analytics for Firebase (Google Inc.

1. Google Analytics for Firebase or Firebase Analytics is an analysis service provided by Google Inc.. For more information about Google's use of data, please refer to the Google partner policy.
2. Firebase Analytics can share data with other tools provided by Firebase, such as crash reporting, authentication, remote configuration or notifications. The user can review this privacy policy to obtain a detailed explanation of the other tools used by the owner.
3. Cleverest (iOS version) uses mobile device identifiers and technologies similar to cookies to run the Firebase Analytics service.

5. Your Rights

You have the right at any time to request information about the processing of your personal data by us. We will explain the data processing to you in the context of the provision of information and provide you with an overview of the data stored about your person.

If data stored by us is incorrect or no longer up-to-date, you have the right to have this data corrected.

You may also request that your data be deleted. Should the deletion not be possible due to other legal provisions, the data will be blocked so that it is only available for this legal purpose.

You can also have the processing of your data restricted, e.g. if you are of the opinion that the data stored by us is not correct. You also have the right to data transfer, i.e. we can send you a digital copy of the personal data you have provided on request.

In order to make your rights described here applicable, you can contact us at any time using the contact details listed in section 1 above. This also applies if you wish to receive copies of guarantees proving an appropriate level of data protection.

You have the right to complain to the data protection supervisory authority responsible for us. You may exercise this right with a supervisory authority in the Member State where you reside, where you work or where the alleged infringement occurred. The competent supervisory authority is in Berlin: Berlin Commissioner for Data Protection and Freedom of Information, Friedrichstr. 219, 10969 Berlin.
